Terms of Use

1. Acceptance of Terms

By accessing or using goindigoenergy.com (the “Site”), you agree to be bound by these Terms of Use and by our Privacy Policy, available at goindigoenergy.com/privacy-policy/. If you do not agree, please do not use the Site.

2. Use of the Site

You agree to use the Site only for lawful purposes. You will not:

  • Attempt to gain unauthorised access to any portion of the Site or related systems.
  • Use automated tools such as scrapers or bots to extract data from the Site beyond what is permitted by our robots.txt.
  • Submit false, inaccurate or misleading information through any form on the Site.
  • Use the Site in any way that violates applicable federal, state or local law.

3. Enquiries, Estimates and Proposals

Any pricing, system sizing, production estimates, payback periods, timelines or incentive figures shown on the Site or given in response to an online enquiry are estimates only. They are based on typical projects and publicly available information, and they do not constitute a binding offer.

Incentive and tax information on this Site — including the federal investment tax credit, elective pay for tax-exempt organisations, and California programs such as SGIP and net energy metering — is general information, not tax advice. Eligibility and the amount you can actually claim depend on your own circumstances. Consult a qualified tax professional before making a decision based on it.

Final pricing, scope and contract terms are determined only in a written, signed proposal from Indigo Energy covering your specific solar, battery storage or EV charging installation. Neither use of the Site nor submission of an online enquiry creates a contract or obligates either party to a transaction.

4. Intellectual Property

All content on the Site — including text, graphics, photographs, illustrations, design and code — is the property of Indigo Energy and Solar Inc or its licensors, and is protected by United States and international copyright, trademark and other intellectual property laws. You may view and print pages for personal, non-commercial use only. Reproduction, distribution or modification of any content for commercial purposes without our written permission is prohibited.

5. Third-Party Links and Tools

The Site links to third-party websites and embeds third-party services, including Google Analytics and Google Tag Manager, and HighLevel form processing. We also link to government and utility resources such as the IRS, the California Public Utilities Commission and SDG&E. We are not responsible for the content, privacy practices or accuracy of third-party sites. Your use of any third-party site is at your own risk and subject to that site’s terms.

6. Disclaimers and Limitation of Liability

The Site and its content are provided on an “as-is” and “as-available” basis without warranties of any kind, either express or implied. To the fullest extent allowed by California law, Indigo Energy disclaims all warranties of merchantability, fitness for a particular purpose and non-infringement.

Indigo Energy is not liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Site, including but not limited to lost profits, lost data or business interruption. Our total aggregate liability for claims related to your use of the Site is limited to one hundred United States dollars (US$100).

7. Installation and Equipment Terms

These Terms of Use govern your use of the website only. System design, equipment specifications, manufacturer warranties, workmanship warranties, installation scope, permitting responsibilities and utility interconnection are set out in the separate written proposal and installation agreement we provide for each project. Nothing on this Site modifies, replaces or supplements those separate agreements.

8. Communications and Consent

By submitting your phone number through any form on the Site, you consent to receive calls and text messages from Indigo Energy about your enquiry and related information. Message and data rates may apply. You can opt out at any time by replying STOP to a text, or by calling 858-281-5110. Reply HELP for assistance.

9. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or from your use of the Site will be resolved in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

10. Changes to These Terms

We may update these Terms from time to time. The Effective Date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
